WHISKAS MONEYBACK GUARANTEE PROGRAM
TERMS & CONDITIONS
- Whiskas Moneyback Guarantee Program (“Program”) is is being organized by Mars International India Private Limited (“Mars”) in association with 4 Minute Mile Marketing Services Pvt. Ltd. (“Organizing Partner”). starting from 16th September, 2024, to 15th October, 2024, and is only applicable on specific products that are distributed in India.
Applicable Products: Whiskas Gravy Chicken80g/Whiskas Wet Chicken 80g and Whiskas in Jelly Tuna 80g, Whiskas Gravy Chicken Junior 80g, Whiskas in Jelly Tuna Junior 80g 80g (“SKUs”). Please note that this Program is not applicable to combination packages or multi-piece packages of the Applicable Products.
- Validity: The offer is valid from the period of 65th September, 2024, to 5th October, 2024 (“Program Period”). Mars shall have a right to discontinue this Program before December 31, 2024, without any prior intimation or reason(s) thereof.
- Eligibility: The program is valid for all residents and citizens of India who are above the age of 18 years.
- The Whiskas Moneyback Guarantee Program will be valid in the state of Maharashtra India, provided the product is purchased from an offline (physical) store in Maharashtra with a copy of the invoice.
- Claims must be made within 30 days of purchase.
- Claims need to be placed on the website www.whiskasmbg.theofferclub.in[
- Proof: To claim moneyback the Claimant needs to upload the following on the aforesaid website, (1) an unedited video must clearly show the specific pack being opened and served, as well as the cat consuming the contents until finished. If the cat comes close to the food and walks away without eating it, you may claim a moneyback on the used pack(s). The video must visibly display the opened pack(s). Each cat should be served one pouch or less. (2) Additionally, a copy of the invoice must be uploaded. (3 (3) UPI Id of the Claimant must be provided.
- Any video, which in Mar’s sole opinion is obscene, vulgar or otherwise may offend the public will be disqualified and any participation after the date of the close of the Program Period shall be invalid and the entry of such Claimant will not be considered for the Program.
- If for any reason this Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Mars/ Organizing Partner which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, Mars reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program, subject to any written directions made under applicable State or Territory legislation.
- Mars Consumer Care Team/ Organizing Partner will get in touch within 48 hours of request on Microsite. After being satisfied of the veracity of the proof provided, refund processing will be done within 72 hours subject to other T&Cs.
- A maximum of 1 (one) claim may be made per Claimant. Use of multiple addresses/phone numbers to make multiple claims will result in all claims being rejected and where appropriate, Mars shall have the right to take appropriate action in law.
- Maximum entitlement of a claimant to money back is limited to the equivalent amount mentioned in the invoice i.e., the amount actually paid for each individual pack which is opened in the video submitted and shall not be more than the MRP of the respective SKU.
- All refunds under this Program shall be made directly to the Claimant, subject to review of the proof submitted via microsite (www.whiskasmbg.theofferclub.in). In the event the proofs submitted are incomplete then the Claimant will be disqualified. This Promo entitles the Participant to the Cashback on their bank account via UPI.
- The Participant will be responsible for entering correct details such as UPI ID, Mars/Organizing Partner will not be responsible for any incorrect entries or details on the Promo Platform or the resulting loss or failure to receive the Moneyback due to incorrect details. No change in details will be entertained once the Participants have submitted their details.
- All Participants agree that UPI partner offering this Promo may at any time stipulate additional terms and conditions for redemption of the Pack and such terms and conditions shall be binding on the Participants and shall apply to every redemption of Pack by the Participants.
- The UPI partner holds the right to refuse transactions deemed fraudulent as per their policies.
- In the event of any fraud detection, the UPI partner reserves the right to modify/change, discontinue, terminate, withdraw the Cashback at any time during the Promo Period..
- A maximum of one Pack can be used per mobile number /UPI ID during the Promotion Period.
- The UPI partner reserves the right to restrict Moneyback for any account with suspicious behaviour or invalid details/credentials. The wallet partner has the right to ask for documents to prove the customer/user identity.
- Mars and Organizing Partner shall not be held liable for technical issues including but not limited to Participant’s KYC being incomplete, account not being active, login issues, account being blocked etc. relating to the redemption.
- Any Claimant found to be manipulating or being untruthful through unlawful or/unethical means shall be disqualified.
- By submitting the proofs for the Program, each of the Claimant, grants toOrganizing Partner, an irrevocable consent in perpetuity to use his/ her name, video provided to Mars/ Organizing Partner in connection with the Program, at any time and on any and all media, whether now known or developed in the future relating to advertising and promotion etc., in the form of text, articles, audio, visuals or any combination thereof.
- If the Claimant has collected the money back basis submission of some incorrect information and the error in his/her information is detected subsequently, Mars/ Organizing Partnershall have the full right and authority to pursue legal action against such Claimant to recover the money wrongfully collected by such Claimant.
- Employees of Mars/ Organizing Partner or any third parties connected with this Program, and immediate family members of such persons are ineligible to apply.
- Participation in this Program implies acceptance of all the terms and conditions of the Program.
- Mars/ Organizing Partner reserves the right to reject any and all claims that are contrary to these Terms and Conditions.
- The running of this Program and these Terms and Conditions are subject to force majeure circumstances including without limitation, floods, pandemic, lock-downs, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of Mars/ Organizing Partner (“Force Majeure Event”).
- Mars/ Organizing Partner reserves the right to amend these Terms and Conditions at its sole discretion from time to time where reasonably required or can withdraw the Program at any time.
- The decision of Mars about the Program shall be final and binding upon all Claimants.
- All disputes shall be subject to the exclusive jurisdiction of the Courts in New Delhi.
- Mars/Organizing Partner shall not be liable for:
i. Any incorrect, incomplete, or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promo and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with Promo Platform/servers/telecom networks/other platforms used in this Promo.
ii. Any printing or typographical errors in any materials associated with the Promo, injury, or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Promo.
iii. Organizing Partner is responsible for honouring the Moneyback payment to Participants. Mars/Organizing Partner or any of its employees, directors are in no way liable for Moneyback in any manner whatsoever.
